Pilot terms for TrapSpotter Fleet

The terms of a TrapSpotter Fleet pilot, which we set up for your company after a demo.

1. What the pilot is

1.1 A pilot lets a business (the customer) use TrapSpotter Fleet free of charge for 60 days, without a payment method. TrapSpotter BV (TrapSpotter) sets up the pilot by arrangement with the customer and confirms the start and end dates by email or in the console.

1.2 A different duration may be agreed in writing, up to a maximum of 90 days.

1.3 The business terms and the data processing agreement also apply during the pilot. These pilot terms supplement them and prevail in the event of a conflict.

2. What the pilot includes

2.1 Everything the Fleet plan includes: workdays and trips, hours, clients, vehicles and documents, receipts, live positions (off by default), "Who was driving?", the mileage statement and the exports.

2.2 Each seat gives the driver TrapSpotter Premium for as long as the pilot runs.

2.3 The number of drivers may be limited when the pilot is arranged.

3. Free of charge

The pilot costs nothing. No payment method is requested and there is no invoice for the pilot period. A pilot counts as the company's trial: after the pilot, there is no second free period.

4. The customer's obligations

From the first workday, the customer's obligations as an employer under the business terms apply: informing the drivers, documenting the use, involving the employee representatives and carrying out a DPIA where the law requires it. A pilot is no reason to skip those steps.

5. At the end of the pilot

5.1 Continuing. The customer adds a payment method in the console. The subscription then starts at the end of the pilot, without interruption, at the Fleet price (€4.95 per seat per month, excluding VAT, at least three seats).

5.2 Stopping. If the customer does nothing, the pilot stops on the end date: no one can start a workday any longer, ongoing workdays stop and the seats no longer give Premium. Nothing is invoiced.

5.3 Data. After the end of a pilot without a subscription, the customer can still export its data in the console for 30 days. After that, TrapSpotter erases it within 30 days, as set out in the business terms and the data processing agreement. If the customer starts a subscription within those 30 days, the data is retained.

5.4 Either party may end the pilot early at any time, by email or in the console. Clauses 5.2 and 5.3 then apply from that date.

6. Feedback

TrapSpotter may ask the customer for feedback during the pilot. The customer is not obliged to give it. TrapSpotter may freely use suggestions.

7. Liability

Because the pilot is free of charge, TrapSpotter's total liability during the pilot is limited to €500. The exceptions in the business terms (intent, fraud, gross negligence, death or personal injury, and what the law prohibits from being limited) also apply here.
